Which corner is closest to you? of the Alabama. SPECIAL NOTE! I am not an official surveyor, our knowledge of the tools and how they are applied have many similarities, but they are very very different. I get that more often, and it drives surveyors crazy trying to explain why. Surveyors have legal anchor to the US Constitution. Anything from me is a professional recommendation. My stuff can be rejected just cause they dont like it. Surveyors, nope. My job is in the ROW, surveyors set the ROW.
For me and surveyors, we dont think about the row when are working. My Great crazy uncle I knew there would be something, he went everywhere running the same game. I saw 1900 Century Timber fast railroad. Yup still in the ROW. That sign needs to move out the highway danger part of the row. I said put it in the nice park where folks can get a lesson and joint.

Do you know how to determine your position by observing the time of appearance of the moons of Jupiter? Or is that a lost skill? Darryl, I am not sure on some of your questions, but adverse possession is a real thing and you need to consult a lawyer on the best way to proceed.

Do surveyors have a legal right to step on a neighbors property to complete a survey? Does someone own the air space directly straight up? Like if a tree branch is over the line? Would it be wise to build a fence on the line or step back and if so how much? Also I remember hearing something about someone using your property for a certain length of time and it becoming theirs something about adverse possession I think. My neighbor is encroaching about 25’-30’ on my small lot with his stone wall, bird baths, statues and some kind of voodoo circle. I know some of these aren’t for a surveyor but someone may know. 1. Yes. But with some conditions. 2. Air space is lawyer 3. I would not build it on the line. I would build it where the edge of you corner post are inside boundary. Pin on outside edge of your corner post 45deg. Think about walking a north and south fence line at 0 deg. Once you get to a corner post you want pin outside edge of post at 45deg. This is so pins are always there and can be retraced. Usually you get to a corner post and there is flagging you can look on outside edge of post and there is pin. 4. Adverse possession is a thing but has some requirements that have to be met. Hostile. Exclusive. Open and notorious. I hope this helps. This is what I have experienced. I know golden eagle is a surveyor. Maybe he will chime in a give his opinion on what he has seen.

First, can you talk to this person? If you know your property lines with survey rods/irons that you can locate at the corners of your property and you have an old survey that shows that these are your property lines, then a polite conversation to show they are on your property may be all that is needed. 25-30 ft incursion is a pretty big incursion on your property!
If they won't respond to facts and reason then you may have to seek a legal resolution. Way cheaper if you can work it out on your own!!
Overhanging limbs can be trimmed but again it is nice to let your neighbor know you plan to do this and trimming the branch as it comes off the main trunk might be healthier for their tree.
If you are paying for the fence then I would put just inside your property line so you can do what you want with it.

Surveyors cannot get on your property without permission. Per my surveyor. They have to ask. He also told me to build a fence a couple inches off the line. I’m going through this right now. Can’t answer the rest. If a neighbor gives a licensed land surveyor or one of their employees denied access call the sherriff and they will escort surveyors.

Chiller, I know you have dealt with this many times. The difference between a ME and You. My job is to find wierd things in common places. Thats IT!
I called a Chiller to set my pins! I am not legally able to do that myself. I can to it to legal specs with my almost similar to Chiller's tool box, but thats IT!
Yesterday, I REQUESTED IMMEDIATE ACTION for a sign to be moved sign out a dangerous location in relation to the highway. It was an immediate danger, I said this needs to be fixed before terrible accident. Thats it, the rest is on the State of Florida, not the town of Century. I'm checking old signs.
Somebody like Chiller set that line, That I know as the DANGER line for the highway. Thats IT!
Chiller is banging his head against mine right now.. People like Me, or an Environmental Scientist, only give recommendations that the law requires for a permit. Like a building Inspector. Thats it.
THE LINE, that somebody like Chiller sets, is my Work space wall. If Chiller can giggle once. He knows. Surveyors dont laugh much, they know people do not understand straight lines at all.

I have to make aa video class of real experts explaining ROW to the genral public. Good lord. All those wierd drawing crayon pictures, thats a sketch map for immediate thought about a situation. Its quick reference for a report. Chiller does that for those funny triangle and weird curves and stuff. But for a VIEW SHED analysis that is how it starts.. What people see when they drive. Like a weird blinding reflection that shifts a lane to the left when they should not. Big glass building cause car wrecks everyday. Chiller also know that property corner are always piles of mixed trash because it is a corner. One of those pipes or rebar is the one he wants to find. Sometimes its such a mess; he just goes to another and shoots the spot in the pile of crap. I got a corner at this house, with 70 year old goat pen oor something made of hammered random iron things. My contracted pin planter (Chiller) figured it out. I got a new pin. not a First Pin. Surveyors always like oto shoot from a first pin when they get the chance. Its corrects a lot of old error along the way.

Chiller is not my surveyor. My corners are preserved with a Bridge Pole set 45 on center from the First Pin just like he said up there. It makes the clarification of Row and property easier for everybody.

I’ve been doing a little work similar today. Went around finding corner markers, Section line markers and etc A lot of walking, but it’s rewarding knowing that I know exactly where corners and lines are. I still have 3 or 4 that I may find tomorrow. “A nail in a marked rock” was one of the markers according to an old survey. I never thought I’d be able to find something like that. Old school land line painters used to triangulate the corner stob with blazed witness trees. There’s no “formal” way to mark the witness trees. Some put an X on each tree and others use three vertical marks.
