I'd advise anyone NOT to trespass to make a citizens arrest anywhere, anytime. Yer asking for trouble....
call the GW and let him handle it, it's what they get paid for.
Furthermore my advise to most folks is to call the GW if you see someone on your land hunting without permission. Again, it's what the GW gets paid for, and what they do all that training for.
And, most important, a POACHER will give a private citizen a LOT more trouble that that same poacher will give a GW in uniform. PERIOD. Been there, done that. Over the years I caught a bunch of poachers when I was off duty hunting on my own. Almost to a man they gave me a hard time till I convinced them I WOULD shoot them if it came to that. Most folks aren't willing to go there, and shouldn't be confronting poachers.

troy Did you ever tell anyone you could'nt do anything about a crime because it wasn't committed in your presence, even when the person that reported it to you saw the crime in progress? I don't think these guys understand the difference in arrest with a warrant, and arrest without a warrant. Can you think of any reason why this person who repeatedly sees a neighbor hunting over bait cannot take pictures as evidence to support his testimony, or even get other witnesses to participate and coroborate his testimony, and then swear out a warrant for the viloator's arrest without trespassing, fighting, getting shot at or even confronting the violator until he has been arrested?

49r, I don't see a warrant clerk issuing a warrant based on long range pics of someone pouring "something" out of a bag...can you PROVE it was something illegal that they poured out...and PROVE the identity of the person pouring it out...and show/prove they had a LOADED deer rifle and not a childs BB gun???

49'r, lets get a couple things straight. 1. I can and will handle my own business. On two occasions in just the past 10 yrs, I've held people at gunpoint, on my property, waiting for the sheriff to pick them up. In 1990, I came within 1/8" of trigger pull of shooting two poachers that I caught on a lease I had in Choctaw County. We were way out in the woods and they said they were gonna leave me in the ditch. That wasnt acceptable to me and I called their bluff and they decided I was serious. They got picked up by the LEO too. I was 23 and stopped and puked in the ditch on the side of the road once all the adrenaline left me on the way back to the camp. If you are dealing with people with guns, you'd better be prepared to go all the way, I was then and am now, and I stress this point, if the situation warrants it. Just so we are clear, I'm not one to whine,complain or not face things head on. One on one confrontations do not bother me in the least. 2. I'm not complaining about the game wardens. They do a fantastic job considering they are severely understaffed, overworked, underpaid, and have way to much territory to effectively work. I will also mention that they have the most dangerous job known to man. 90% of the people they deal with everyday are in some way armed. They have issued citations to this guy and his family members on 3 occasions so far. If I call and they cannot get there, they make note of it and attempt to catch him or check the area on a later date. That's all you can ask for. 3. The guy is breaking the law. Now, I know from your previous posts that you dont think we need any game laws and everyone should be able to shoot what they want etc. For the record, baiting is against the law and until the law changes, it is my duty to report him each and everytime I see it happen. 4. You like to do research and copy and paste regs more than anyone I've ever seen. Take a minute to read your own license. There's a toll free number on it requesting that you report wildlife violations so it is somewhat of a civic duty. 5. Ipullhondas, sorry for your thread gettting highjacked. I jokingly mentioned my neighbor when asking about the baiting portion of it, 49'r got me started and it pissed me off so I violated my own rule and got into it with him. My apologies to all.
