Section 9-11-244 is the statute that prohibits taking of birds or animals by means of bait. Section 9-11-246 provides the range of fines and punishments for hunting over bait. The penalty for hunting deer or turkey over bait is a fine of not less than $250 and not more than $500 and the Court, in its discretion may revoke the defendants hunting privileges for up to one year on a first conviction. The second and each subsequent conviction carries a fine of between $500 and $2,000, loss of hunting privileges for one year and imprisonment in the county jail for a minimum of 10 days and a maximum of 30 days. Each of the scheduled fines is exclusive of costs. For baiting small game the fine would be $25.00 and not more than $100 for a first offense.
