So if I take my wife fishing and she just sits in the back talking on her phone and watching me fish and complaining about the heat does she need a fishing license? If a game warden came upon you would he/she know if she was fishing or not, no, for all he/she knows you saw them coming and put the pole down. What if she grabs a net to hand to you, is that assisting in the taking of game fish? When in doubt contact the DCNR

Alabamas legal definition of hunting is very broad. It covers just about everything except sitting still watching or taking pictures. Any assistance to a hunter can be considered hunting under the law. To answer your question, no, she doesn't need a license to sit with you anywhere including a national forest to wma anymore than she would need a license to walk around in the wma with a camera. That said, a license would be cheap insurance from any problems that could come up. An a hole could make a case for a ticket if he thinks she is helping you hunt in some way. It may not stand in court but by that time it has cost you more than a license anyway. Good point. I think I'll just break down and buy the extra licenses. Thanks for all the answers.

I asked this very same question in an e-mail to the DCNR years ago, their reply was that if she accompanies you on a hunt she is basically hunting and should have a license. This includes WMA and National Forest. I told the DCNR that she would not be carrying a weapon, they told me that it did not matter. If she points out a deer to you that you don't see then she is assisting in your hunting efforts. I do know that at Oakmulgee we were stopped by two GW and both of us were asked to produce a license, we both had one and we went on our merry way. IF in doubt go to the DCNr website and e-mail them, they usually respond with 24 hours. Take this for it is worth. ain't saying you aren't telling it like you were told....but that info in BS from DCNR. Thats like saying while she is standing in the yard while you hunt she is hunting. Horsechitttttttt.
I've spent most of the money I've made in my lifetime on hunting and fishing. The rest I just wasted.....

If she isn't hunting/fishing/trapping/etc she does NOT NEED A LICENSE anymore than you need a driving license if you're riding passenger with yer buddy doing the driving down the road.
I've spent most of the money I've made in my lifetime on hunting and fishing. The rest I just wasted.....

I was told by a current GW that anyone that participates in the hunt needs a license. He used some examples of participating, like pointing out deer or helping to drag one that had been killed. I'd play it safe. Even if a ticket is thrown out, it will cost you a day of work in court to do so.
