Archie asked him to show him the bait and the warden told him he couldn't because it was gone but it hadn't been gone for 10 days. Archie had no knowledge of the bait or location therefore won in court.

Game warden should have been fired. I have no problem with wardens doing their job. I don't like those who are trying their best to bust someone who is obviously trying to obey the law. I wish they would take the attitude of a servant rather than an enforcer. It's the attitude that makes all the difference.

I Don't know diddley about that case but Archie Phillips is worth a small fortune. He also had a vested interest in keeping his "law abiding citizen/hunter" status since he had an outdoor show and outdoor business. Most of us average guys wouldn't have deep enough pockets to appeal it all the way to the Supreme Court.

Read the actual court documents I linked in the post before this one before judging the game warden.

Notwithstanding anything herein to the contrary, any person who violates the provisions of Section 9-11-244 with respect to the taking, catching, killing, or attempting to take, catch, or kill, deer or turkey, shall be guilty of a misdemeanor and, upon conviction, shall be punished for the first offense by a fine of not less than $250.00 nor more than $500.00, and at the discretion of the court may have all hunting privileges revoked for up to one year from the date of conviction. The second and each subsequent offense shall be punished by a fine of not less than $500.00 nor more than $2,000.00, and the automatic loss of hunting privileges for one year from the date of conviction, and, at the discretion of the trial court judge, imprisonment in the county jail for a period of not less than 10 nor more than 30 days.

The fine is exclusive of costs which could be as high as the fine amount. In Lowndes County a first offense is $500 comprised of a $250 fine and $250 costs. If the offense was egregious, the Court has discretion to revoke hunting privileges and levy a higher fine. Hunting over bait is a mandatory court appearance in this county.

Fair enough, but give me the short version for dummies concerning the GW's justification.

certainly the way it should be. No one should feed deer, but as long as everyone else feeds them and you don't they will all go to the next property.

I like that everyone says they don't feed deer corn. A month to go in the season and the last 2 Walmarts and co ops I went to are all out of whole corn. I never saw that before.

I don't need to feed. The neighbors feed, but I own the bedding ground.

Seen the GW at our club in Pickens county 2nd weekend of gun season he waited for us at the gate seen all the Orange in the truck and was happy asked to see our license we gave them to him said he just wanted to make sure everyone keeps them on them they been on them hard about checking. I asked if I was to put corn out 100 Yards out and out of site if I could hunt a trail going to it and he said it was LEGAL. I'm just glad he didn't check my rifle bc it was loaded inside the truck

Here. This is directly from the court documents...

"The state's evidence tended to show the following.   On March 30, 1995, Willie Morris, an officer with the Alabama Department of Conservation and Natural Resources, received a telephone call from Don Taylor.   Taylor told Morris that he had found wheat in a turkey he had killed at a hunting club located adjacent to Phillips's property.   The following day, Officer Morris, accompanied by Taylor, entered a wooded area of Phillips's property, where Officer Morris found a large amount of wheat scattered on the ground.   Sprouted wheat, as well as seed wheat, was present, and there were numerous turkey scratchings on the ground.   Officer Morris returned to the same part of Phillips's property the next day and found Phillips and Guy Moore hunting turkeys in the area where he had found the wheat the day before.   Phillips and Moore were charged with hunting over a baited field.

At trial, Phillips denied placing the wheat on his property or knowing that there was wheat there.   He claimed that Taylor had actually placed the wheat on his property in order to "set him up"."

Seems strange that the GW allowed neighboring landowner onto another persons property. I would be livid just with that fact.

Many moons ago we had a lawyer in our club that got busted over corn. He asked the warden how he found it and the warden slipped up and said old whoever found it and called us. The lawyer told the warden he wanted the trespassing neighbor arrested and the best I remember he followed thru with it.The nosey neighbor's fine was double the lawyers in the end.
