Keep in mind ATVs in AL have no registration so checking to see if they are stolen from down in the woods is no easy matter. Also keep in mind I've been playing the devil's advocate in giving you why a complaint would be useless. Sure taking the keys was pretextual to keep the hunter from leaving, but it is also easily explained as a more reasonable action.

The bottom line is when you are in law enforcement , you have to use all legal and constitutional means available at your disposal. Sometimes people don't like it if it happens to them but that is how it works. The criminals have no regard for the rules so LE has to stretch them as far as they can as long as they stay within the boundaries and don't break them.

Call Mark Rouleu and ask him if it is OK if you doubt me.

How many people think it is wrong to tell a bald faced lie to a suspect during interrogation? The Supreme Court says no problem at all, it is just an investigative tool.

thumbup On private property I always leave the key in my wheeler, damn fine place for it. Won't get lost unless a GW comes by and takes it. Like I said before, JA's wheeler wasn't lost or stolen, he knew right where he parked it.

The Constitution doesn't guarantee the right to the truth but it does guarantee the right to be free from illegal seizure of personal property not suspected in the use of a crime. I don't have to call anyone to know my rights since the Constitution lays them out very clearly so as to protect citizens from overzealous law enforcement and government.

Based upon the story told here, I feel very confident that Jinright was not working without his duty belt and uniform. My guess is that his turkey vest and shotgun where leaned up against a tree somewhere close by and he wanted to see who had come in on the four wheeler.

I don't know who the guy is but law enforcement are the last people I'd ask what my rights are. I'm not saying all of them are bad but there are enough that I'm not rolling the dice and trusting them to tell me the truth or even be aware of those constitutional protections.

Sorry you don't like it, but no way is seizing control of what could be considered an abandoned ATV for investigative purposes going to be considered a constitutional violation.

I didn't say you had to know a crime was committed. In front of a court I believe a good lawyer would make quick work of any officer going off of such a weak premise. An officer might give himself a lot of leeway that the Constitution and courts don't see the same way. Happens all the time.
