I haven't posted in a while because there has been no word. As many of you know we filed an appeal with the Alabama Supreme Court.
This morning we received a call from our Attorney Ben Hand, letting us know that, after 2 LONG years of dealing with this we finally have a decision:
THE CASE WAS REVERSED AND REMANDED FOR ACQUITTAL!!
Hallelujah! While the wheels of Justice turn slow, they do turn!
It has been a LONG AND STRESSFUL, not to mention costly, 2 years. It is a relief to know that this part is over.
I do find it disheartening that the Lowndes County Justice system would allow this to happen based on the word of a retired game warden. 3 boys were arrested, tried and found guilty all because of something this RETIRED game warden heard. As it was stated - "Mr. Morrow has given 20 years of good service to this community and I value his opinion"
This was the epitome of the SMALL TOWN JUSTICE!
A special thank you to our Attorney Ben Hand, without him none of this would have been possible.
As we move forward with trying to get this expunged from their records and other proceedings I will keep you posted.

I used to have a lease in Lowndes co. and there is no justice like it any where especially with regards to game wardens

I am waiting on a copy of the decision from the Attorney now. He did tell me it was a 42 page decision.

Glad to read of the final decision. Hard to believe it's been 2 years.
Seems like I was reading it less than a year ago when it happened.

I was just going to post this. I read the opinion this afternoon. The court said the state failed to make even a prima facia case. Glad they were vindicated.

Doekiller, can you give some insight for those of us who don't don't see the inside of a courtroom how a case like this that has no merit can continue on for so long and has to go all the way to the Alabama supreme court??? Does this happen more than we realize?

Wow, just amazing. Should have been dropped early on, I just don't get why they would make the decision to continue to pursue this case when there is so much other stuff they should be focusing.
And I had to look up prima facial, had a typo, and found some really great porn! Oh and I still don't know what prima facia means.
