Augustus 65 May have made a career ending mistake tonight by posting what he did. That just didn't sound right at all. I would like to think that the end of his run as judge is very near. Not unless there are enough ALdeer members that are voters in Lowndes County. If he keeps looking out for the locals, they'll keep electing him Pretty sure he is a Democrat that ran unopposed in the general election. Tells you a lot there.

Not unless there are enough ALdeer members that are voters in Lowndes County. If he keeps looking out for the locals, they'll keep electing him I'm not 100% on what the law is on misconduct by a judge but I am very familiar with trial by media and these days that gets more results than actual law. I would imagine there are a few hungry reporters that would make a story on this if given the right leads and Augustus's own words make for a compelling story in this situation. I can't say for certain that it will be the end of his part of the good ol boy system but I can say that what he has written doesn't look very good for him in the media.

You will sleep better. l had a feeling he might delete his post admitting his misconduct and poor judgement. That's why I took a screen shot, in case it might be needed later. Those boys were screwed by a retired idiot. I hope they sue him and take everything he owns ! He should stop trying to be a super cop and take the time to admit he was wrong and try to repay their legal fees. He caused them let him suffer ! No kidding perch. I've never heard of anything as ridiculous as this. No probable cause or right to detain anyone. Civil rights violations and impersonating an LEO. Do judges in rural Alabama even have to graduate law school and pass the bar? Retired GW without ID lucky he was picking on kids and not grown men. I mean a fellow pulls in behind you raising cain and claims to be an officer and has no badge. I myself would be talking back with a Shield in my hand.Folks are crazy these days and that could have got out of hand real quick especially if you haven't done nothing that your being accused off. Thank God I live in Jackson county. That's a fact there. Somebody tries that with me, when I have done nothing wrong, they are going to be at gunpoint before the situation is over.

As deer season approaches, all the hunters out there might want to pay close attention: FACTS Basically, a conservation officer believed he heard shots being fired from a truck driven by these defendants around 6:30/6:45 at night. He didn’t see anyone fire a weapon or even a muzzle flash –essentially, he only heard what he thought were shots fired from a gun. No shell casings were recovered and the deputy sheriff that later investigated couldn’t determine whether shots had recently been fired from the rifle found in the defendant’s vehicle. The defense argued the State couldn’t make a prima facie case based on this paltry evidence. The State relied on Rogers v. State, 491 So. 2d 987 (Ala. Crim. App. 1985) to defend the sufficiency of its showing, which held that the State presents a sufficient case of “night hunting” when it shows “that the accused (1) is in an area which deer or other protected animals are thought to frequent, (2) has in his possession a light, and (3) has in his possession a weapon or other device suitable for taking, capturing, or killing an animal protected by state law, (4) at night.” The circuit court and Court of Criminal Appeals agreed, relying on Rogers for all the offenses. HOLDING – REVERSED AND RENDERED The Court rejected Rogers on the theory that attempts to commit these hunting offenses require more than the Rogers standard provides. The Court’s discussion here is an interesting look into “the commencement of consummation” of a criminal offense, focusing on the holding of ATM v. State, 804 So. 2d 171 (Ala. 2000). Because Rogers did not accurately encompass “attempt” jurisprudence, the Court overruled that decision. In applying the accurate law regarding attempts, the Court found the State’s case insufficient and vacated and rendered the convictions. This case is a great standard for assessing the sufficiency of “attempt” prosecutions.
