I think he'd lose this argument if it ever got to a court. DCNR has promoted the WMAs for years as "public lands, for everyone (within regulations)" - with emphasis on, but not sole use of, hunting. They have had talks with birders, campers, horseback riders and other users, offer campsites, have birding trails (I think) and generally have promoted them for public use.

Sounds like you could have the permit and license and just say you were hunting birds to take pictures of with your phone camera.

I think it should be mandatory that if you hunt in a WMA that you have to do it with bare feet, while in a loin cloth and carrying a spear.
