So is it a break in when you leave your schit unlocked? Whether it be a truck or house or whatever. I say no. These days you leave anything unlocked and anyone will " help their self" to your shucks. Yes it's still considered breaking and entering. Felony charge the law said they would be charged with 2 felonies Technically, there is no crime of breaking and entering in Alabama except B&E of a Motor Vehicle. The crime that occurred was Burglary 3rd which is a felony. The only other felony that could be included would be Theft 2nd based on the value of all the items, but understand that charging them with both is simply plea bargain leverage. In the end, they will only be convicted of the burglary unless they and their lawyer are both pretty dumb. This....
