Read only what the judge said, and it sounds like the AL legislature did a very poor job of writing the law. Instead of appealing, the legislature needs to try again. The way it's written, a 22 yr old teacher could date a 19 yr old Sr from another state and be declared a criminal and a sex offender. I could have told them that was too broad. That is the basic criticism from the start. Like so many of our laws it was a knee jerk reaction and not well thought out and designed.
Lord, please help us get our nation straightened out.

Here is how I feel about it. If you think it will be a problem then don't be a teacher. Also, if Texas, Arkansas, etc. have laws that are so favorable then go teach there please. Nobody made you choose to be a teacher and you knew the rules going into it. A teacher should be worried about educating and not who they are going to take to fkn prom This. They supposedly know the rules when they accept the job. Don't accept the job and then get mad when you get caught breaking the rules to which you agreed.

The law needs to be changed. It is a horrible law and it is a violation on equal protection under the 14th amendment. We have been over this many times on here. But, the teacher or school employee doesn't even had to teach or work at the same school as the student under the law. Should be a pretty simple concept: Don't bang students. Period. If that is a deal breaker, they should find some other vulnerable group of people to exploit.

Alabama legislature has a bad habit of passing unnecessary laws. We already have a law against statutory rape. That should be good enough. If the people involved are of consenting age, there's no crime. Period. These are the same geniuses who thought we needed an open carry law, to legalize something that was already perfectly legal.

It doesn’t always mean a teacher was misusing a position of power. It can, so there needs to be an option on the books to deal with that but, it’s not always the case. We had a student in high school (senior at the time) that started dating a teacher. Kept it a secret but it eventually came out after we graduated. They’re married now. Been married for 15 years or so. I don’t necessarily agree with it but, if you’re going to have a statute like that it needs to be more specific.

There is a coercion facet to consider but that facet is somewhat murky still. By the current accepted line of reasoning - a person in a position of authority (teacher) renders the ability of the person in the weaker position (student) to provide consent null/void. In other words, because they are the authority, the weaker person can't provide consent from an equal footing.
In cases where the teacher has no authority (student is enrolled at another school or in another state or so forth), that facet is removed and trying to use it as a means to destroy someone's life is morally wrong.
The second part - age - is also wrong. The age has to be consistent in all applications of an age law. We can't say "this age applies for one thing" and then "this other age applies for the same thing but in another context". Again, arbitrary application of different standards for the same thing makes it morally wrong.

To be clear from an earlier post, we had some guys I went to school with that tapped a teacher or two. the thing is that they didn't brag to everyone about it, whether this was out of shame from the desperation or it or chivalry, I don't know but I suspect it was shame.
