I would imagine that the correct charge would be Public Intoxication, which is simply being intoxicated to the point you are a danger to yourself or others. If you have a gun it should be pretty easy to get a conviction on it if you show any signs of intoxication.
Lord, please help us get our nation straightened out.

Drinking at camp the night before we hunt is something we've always done but not while we hunt. Too much can go wrong already without the drink.

I dropped out of a great hunting club last year because of drinking. Im not just talking about drinking at the clubhouse. Ive went to a shooting house and there were 18 fresh beer cans laying outside and the carton was laying inside. They regularly drank while hunting. I had a member offer me homemade one day when I got to sign in. I asked the president about drinking while actively hunting, His response was: Ive been in the club 30 years and weve never had a drinking incident.  I dont begrudge anybody drinking; however, drinking while hunting and high power rifles dont mix. Over the 3 years I was there, it got steadily worse. The club was large (about 30 active members) of these 30, 15 were very heavy drinkers that hunted a lot. To the point of loading beer in backpacks at 5am at the sign in board. I cant help but believe there will be some type of incident one day, drinking member falling out of tree, accidental shooting, fights, ex. Just too much for me and my boys.

Im not sure what someone would be charged with if they were on private land hunting 3 sheets to the wind

When I went through the Montgomery police academy we had 3 game wardens come and take the dui classes with us to get them qualified to deal with that I was thinking they might need the State Trooper for the equipment but I was just speculating they wouldn't have it. What equipment? A breathalysizer or whatever its called. As I said, I don't drink so I don't know what driving or hunting while intoxicated entails. I was just curious because of some things I've seen in the past. Not something I NEED to know. I dont know of any department in Alabama that uses a field breath test. They are not admissible as evidence in this state. You have to be taken to a police station to take the drager breathalyzer.

So if I'm peeing off my back porch and a neighbor walks around and sees me, I "could" be charged with public lewdness even though that person came on my property? Just askin cause I like to pee off the porch
