"and subject to the jurisdiction thereof" - this is the phrase they are arguing has been mis-interpreted this whole time. That illegal immigrants are already subject to some other jurisdiction - the home country they came from - not the US. Makes sense, but I don't think the courts will see it that way. Very similar to another pesky amendment that the left doesn't seem to like, namely #2.
