OP I like most of the rest of us think this is ridiculous. They made the silly law for 100 yards and out of site.
Just for the record...I didnt put out corn in my feed sites. during season..only 200 pounds total...I just didnt want to risk it. And after baiting all year in KY I can tell you corn is NO magic bullet to big bucks at least.
Any deer unless high shoulder, neck or spined will easily run 120 yards. This should be an easy one to win , though the law is written to include "affected area".
Was this deer coming to the corn? They leave that at the Wardens discretion through ambiguity in the wording IMO. Your case is exactly what folks have talked about on here in one way, but a dead deer, lying in the feed he most likely went to 3 to 4 nights a week is Proof of hunting over corn/bait? Then they truly need to make it legal or Illegal..one or the other.
good luck and Im sure Im speaking for a majority here..we look forward to seeing the outcome.
Id love to see doekillers or Lonsters opinion on the matter. They are both Juris Doctorate's. Please pipe in yall if you read this..and Im pretty sure Scott has if I were to guess. He doesnt seem to miss much.
But Troy ( Bhamfred) thinking it wont fly? Hes an ex warden OP. Id trust his call. Love to see what Mbrock and dang Nighthunter would think as well, but they are MIA lately, regrettably.

Matt and Nighthunter are still employed by the department and won't/shouldn't comment on an open case.
I'm not and will comment.
I've spent most of the money I've made in my lifetime on hunting and fishing. The rest I just wasted.....

I told him I would meet him at the gas station to get my ticket but not if he is taking me to jail because I'm a superintendent. Told him the truth without having to tell him much. Told him I killed him working a fake scrape I made. I hunt in Wilmer, and he wanted info on my scope"is it a night vision scope" reply was " it has night vision capabilities of you have a IR light, without the light its not as good as a good glass scope". Asked him if I needed to sign the ticket, he said no (because I wasn't going to). Other than that it was small talk. Once he told me this information got sent to him I figured it was one of 2 things. He was just a middle man in the case or he found it on FB. Either way I gave little little info. I will get my court date. BS

Once he told me this information got sent to him I figured it was one of 2 things. He was just a middle man in the case or he found it on FB There's no way the state has the manpower or funding to be examining literally thousands of posts on FB for possible game violations. Somebody snitched on you plain and simple. Whether it be a friend or foe, someone on FB saw that post and reported it to Fish & Game. I'd hire Paw Paw Troy as my lawyer and let him explain to the judge in one word what this ticket is..... Horsechit

I'm not sure to consider ol Ofc James Daugherty ruthless....lazy...or both? Please keep us updated of the outcome. If he wrote this ticket on what Mr. Levi has stated then this warden does not uphold the integrity of the office. It is truly a scary in America when people can be ticketed just by a photo. Does not say much for Ofc Daugherty’s character and integrity but then again it may speak volumes. Hope he has more to go on than a FB post because if he doesn’t then he needs to be removed from his job.

So if the pic had been taken at night would he have written you for night hunting as well? The burden of proof is on the state and I’d damn sure make him prove it. We convicted a guy last year, on this very site, based on pics....

I’ve certainly learned a lesson here - don’t post pics of dead deer.

I’d be willing to bet Ofc Daugherty’s story is slightly different than the one being told here. Id bet you are right too. Either way, I smell a skunk on one side of the situation. I'd have to have the benefit of hearing both sides before I'm sure where the stench is from.
Lord, please help us get our nation straightened out.
