I’d be willing to bet Ofc Daugherty’s story is slightly different than the one being told here. Id bet you are right too. Either way, I smell a skunk on one side of the situation. I'd have to have the benefit of hearing both sides before I'm sure where the stench is from. His side may be a little different. That's any situation like this but I'm positive he has no proof and I got this from a FB post. He told me his self he doesn't know much about it. He doesn't know where in Wilmer I hunt, he even said dang that's a good deer for Wilmer.

If what the OP is saying is the truth; This is just another example of the rampant stupidity of the people making and enforcing our game laws. The officer that wrote the ticket should be fired if for no other reason for being to stupid and to much of a dick to be involved in any type of law enforcement. I would not pay the fine if I had to go to jail.
If you're gonna be stupid you better be tough.

Do I think you killed it over corn? Yes Hell IDOT we all do but that ain't the point here. If I get busted for violating a game law because a GW put in some leg work and showed up to where I'm hunting and got me then good for him and I deserve every dime I have to pay and minute of jail time I serve. But if post a pic after dark, with corn outside of deer season, with a hunting dog in a non hunting dog county, and a spotlight attached to my .22mag, with no orange on, with a dead black bear, in the river, on a running boat, smoking a joint and drinking a Natty, with a no tresspassing sign in the background, etc. That's a heads up he should probably be watching my ass like a hawk, but he is SOL on busting me for that offense. Unless he ask me and I tell him anything other than "sorry I can't help you have a nice day". There are a thousand explanations explaining the picture that makes this a legal kill.

A LEO could make a case from a FB pic but he would have to of done a lot of leg work, and have more than just a pic of a FB post, and have found a magistrate to sign a warrant based on his total evidence.
I made a lot of cases based on just a rumor, BUT it usually took a LOT of leg work to run down potential witnesses and evidence, sometimes weeks or months to put together a good case that would stand up in court.
I've spent most of the money I've made in my lifetime on hunting and fishing. The rest I just wasted.....

I agree 100% that a photo is strong evidence, probably even rising to the level of probable cause, and I also agree that to meet the Beyond a Reasonable Doubt Threshold, there will need to be corroborating evidence. Plus someone needs to authenticate the photo before it is introduced. In filming all the 1990 protests, when the matter went to Federal Court, before any of the tapes were allowed into evidence, I had to testify that "what was shown on the tapes accurately depicted the scene that I witnessed at that time". That has to be done on photos, or at least it had to back in the day. I will remember that phrase for the rest of my life.
Lord, please help us get our nation straightened out.

I quit doing that a long time ago.
