However, some middle ground probably should be found.
I think forcing them to work weekends on some WMAs or other public grounds is excellent middle ground, excuse the pun. At least one judge, I believe Grider, in Jackson County used to offer this option for those brought before him. They could buy a Lifetime and also work x-hours at the WMA or public boat ramps, or take his sentence. Best I remember he wasn't light on sentences. Most bought the license and did the community service. Judge Grider was one of the toughest judges in the state on game violations , he didn't play.

They also need to increase the ticket cost for the big violations. A $10k fine for night hunting should start curbing that behavior.
As much as people like to yell about putting deer poachers in prison, which a lot of people say, or making fines $10,000 for spotlighting, those things never will happen. First, the prisons are overcrowded. Prisons and jail are two different things, too. It's wholly unrealistic to even think that someone would be put into prison for wildlife violations, unless they're incredibly egregious. It's done now and again but overall, it's not going to happen. As for fines, raising a fine to $10,000 or so for shooting a deer at night would be akin to making a speeding ticket $1,500. Would it stop the violators? No. Plus, it would be challegened in court as a violation of the Eighth Amendment as an imposition of an excessive fine. The Supreme Court recently ruled for a man whose $42,000+ Land Rover was confiscated by law enforcement after it supposedly found about $300 of drugs. He argued that their punishment -- claiming his vehicle, among other fines -- was excessive. After years of appeals, the Supreme Court heard the case and agreed with him. So while today's current fines for wildlife violations are pretty piddly-ass amounts, even with any court costs added, putting them into the Rage Mob Knee-Jerk Reaction category of prison or five-figure amounts is unreasonable. However, some middle ground probably should be found. Several mid-west states are in the $8,000 and up range for spot lighting plus some do restitution . Never heard of them being challenged. I bet they don't have many violators . Prison time is unrealistic , a very stiff fine for road hunting and night hunting is not. Again, blood from a turnip. What ya gonna do when junior ain't got $10k, $8k or even $2k to pay said fine? Those are the ones doing most of the road shooting etc. Junior can work it off . Other states play rough on serious game violations.

2Dogs ,,,, he can be left in jail for a couple weeks too And i understand what you're saying, I get it...I really do. But they're releasing math heads that's been busted 100 times stealing, every day. We ain't got no where to put folks in jail. If you put them to work, who's gonna supervise? I agree that penalties should be STEEP and a deterrent, but they gotta be able to back up what they say they'll do.
The harder I practice, the luckier I get.

I agree that penalties should be STEEP and a deterrent, but they gotta be able to back up what they say they'll do. Most normal stupid people will learn the first time . The hard core night hunter is more than likely al ready a breaker of many other laws so they don't care . Those are the ones they need to drop the hammer on

Just got the sake of conversation.......
I think y’all are barking up the wrong tree with all of that. The fines and how they are are distributed within the system is all set by the Legislature via Law; not DCNR Regulations. The same goes for the licenses. It don't take much to teach most a lesson. It's the ones that have broken game laws a lot that's the problem . You go over board on the first timers you just over kill the punishment

I've spent most of the money I've made in my lifetime on hunting and fishing. The rest I just wasted.....

Easy now...you do realize if you pulled the trigger on that 160" stud 5 minutes past shooting hours, you'd be "night hunting"? And that's a really gray area.

Easy now...you do realize if you pulled the trigger on that 160" stud 5 minutes past shooting hours, you'd be "night hunting"? And that's a really gray area. No gray area according to the law. But I don't carry a watch into the woods.

Guy I'm talking about killed a fenced deer near Montgomery that belonged to the wrong man. $10,000 reward convinced his girlfriend to drop that dime. Deer owner being connected with the prosecutor and three prior felonies got him life. Killed the wrong damn deer for sure. His buddy driving the getaway truck got 10 years!!!!! Newell was landowners name.
