To clear things up, a DV conviction does make you a prohibited person, but if it was a DV based on Harassment or other situation where the US Attorney's office decides it was not a crime of violence, you won't be prohibited.
I know this because we had an applicant that has a DV charge to which he pleaded guilty to years ago. The situation was one where he and his wife got into an argument and pushed each other. The responding officer arrested them both with his report stating that all they had done was push each other. They both pleaded Guilty to the charge. When told that he couldn't carry a firearm and therefore be a police officer, he got the US attorneys office in Mobile to look into it. They later sent he and I a letter saying that the charge was not a violent crime so he was not a prohibited person. You must assume that a DV charge will make you prohibited but the US attorney will look at each case individually if the DV stems from Harassment, Criminal Mischief or other such crimes so not all DV charges in Alabama are going to make you a prohibited person. This decision is not up to the police however, it falls to the US Attorney's office.
BTW, I later learned while doing the guy's background check that he had a Shoplifting charge that he did not disclose so he was no longer considered, but he and I both learned something. He learned that after initially being told he couldn't possess a firearm, he learned that he could and had a letter to prove it. I learned that not all DV charges will make you a prohibited person, at least not in the Southern District of Alabama.
Lord, please help us get our nation straightened out.
