Regardless of his level of intoxication, that is a very long sentence for reckless murder. I have seen those cases get probation before.

I’m torn on this sentence/situation. Just a bad set of decisions and circumstances led to this. I rarely ever drink but rest assured I will not be behind the wheel when I do.

I too think the sentence is overly long. However, if I remember correctly, didnt he initally claim he was not driving the boat or something like that. If so, his initial attempts to conceal evidence and mislead investigators probably played into it.

Don't drink and drive or operate a vessel after drinking! It is a recipe for disaster! I have made countless arrests for DUI throughout my LE career and I cannot recall any of my arrestees that were truly sorry. They were only sorry that they got caught!

There is no good time on sentences over 15 years. He will be eligible for parole after 10 years on a 30 year sentence normally, But, since this is a murder, he has to serve 15 years. Parole for violent crimes is at 15 years of 85% which ever is shorter.

That may be the case for this one as well, but I know it was the one that happened on Smith Lake. The guy claimed his wife was driving. It’s stories like this one that reminds me of what I’m glad I I sold my boat and place on the lake. I never allowed alcohol on my boat. Period. Just too much could go wrong and I didn’t want it anywhere near me, as the operator. Most people that think nothing of having a cooler of beer on the boat for the day would never dream of doing the same in a vehicle.

5 years is the normal sentence for a DUI type homicide.

That guy was very remorseful and took responsibility.

30 years is a lot more then the average sentence for 1st degree intentional murder in most places.

I’ve looked at some of them bac charts myself and realized I was wrong. I swear I looked at one a long time ago that said 2 would get me to .08 and I’ve always thought that was my limit to drive. I’m kind of surprised the limit is a lenient as it is
