The company that I work for has a tri-axle that we use for haul off when we tear out concrete on jobs. When that truck isn't being used for haul off we haul loads of rock for another company. We've had three calls in the last two weeks from people saying we owe them a new windshield because rocks blew off the truck when they were behind it on the road. I've basically been telling them that you're supposed to stay back 300' from a truck like that. But is there actually any liability there on our end if he is loaded correctly and tarped?

Based on conversation with my insurance company when this happened to me twice, it's my problem. There should be some liability on your part though. It should be your responsibility to make sure what you are hauling stays in your truck.

Might want to check truck out. Tailgate bent? Holes in bed of truck? Those rocks have a way of getting out. It ain’t coming over the top unless it’s loaded to high on the back or sides.

3 calls in the last 2 weeks? I’d be checking my damn equipment out. If your equipment is jacked up the right thing to do is take care of those folks.

Trust me I’ve heard it all. I had a dark girl from Ensley call me one day said we boosted her wineshieldz. Asked her exact location. All trucks are GPS equipped and I had no one even remotely in that area. I got her name , phone & address. I rode by her house after she continued to call me to see her car. One of my dumpsters was on a remodel job next door to her house. I told her to go phuck herself. Never heard from her again

And as Toothdoc said. It hits road it’s road hazard. But there’s right from wrong

In my experience...an i drive one everday...its the driver alot of times..if you aint checkin the apron,top of the tailgate, and sideboards...alot of times the tarp only does so much...you got a tarp onit dontchy?

Dad had those calls a lot when he had trucks hauling for the feed mill. Falls OFF the truck, liable....kicked up BY the truck, not liable. Dad's calls were about rocks kicked up by the truck that broke their windshields, not soybean or corn meal falling off of the truck breaking them. I remember him arguing for half an hour, sometimes...finally got a statement from state insurance guy and kept it on file.

The 300' foot rule is a joke made up by some hauler. How can you stay 300' behind the guy when he passes you? When he changes lanes to in front of you? When he's going slow and you have to pass him? When you're in the left lane, he's in the right and an emergency vehicle is coming up behind you? Yeah, some trucker had a buddy with a print shop.

I always heard if it comes straight off the truck into your windshield then it is truck driver's liability, but if it hits the road and bounces into windshield it is car driver's liability.
When I worked as a concrete truck dispatcher, we would wait to hear the explanation from the car driver and as soon as they said it bounced we would say not our fault and hang up
