No citations unless the offense was committed in the officer's presence.

That must vary from state to state. My brother was given a ticket in Florida after he hydroplaned and hit the guard rail. No LEO present at the time of the accident. We also have company drivers issued citations when involved in an accident across the country with no LEO present.


It is an Alabama law that is pretty peculiar to us from my understanding. In order to make an on-site arrest, and a citation is technically an on-site arrest, for a misdemeanor or violation, it must be committed in the officer's presence. In no way does this prevent the officer or victim from seeking a warrant. With Probable Cause it should be granted. Felonies are a horse of a different color.All that is needed for an on-site arrest is Probable Cause.

Turn it over to their insurance and be done with it. Their insurance will fix your vehicle and bill them their deductible

I had a young man run into me years ago. His parents asked me to handle it without insurance and I worked with them. They quickly payed me for the repairs quoted on the estimate. No problem. That was probably 25 plus years ago though. If you want to help them out, call them and tell them how much the repairs are. If they bring you the money, all is good. If not, call your insurance.

Agreed... You don't owe them anything. And you're just giving him a chance to do it to someone else.

Besides what if you try to cut a deal and then they claim that you tried to extort money from them?

Just an interesting piece of info. If you fill out the SR-13 and mail it to the state stating they haven't paid you, the state will notify them that they have so many days to provide proof the issue has been taken care of, or they start suspending licenses and revoking tags.

It's even more funny when the person is driving one of their parents vehicles, because the state doesn't care who owns the vehicle, the just revoke the tag on it until you pay up. Usually takes about 90 days or so before the person gets notified, so they think they got away with it, but.....

I did that twice. One guy my then wife filed a case in small claims court and got a default judgement. It was all good until he decided to sell some property. He called me and said it would be a cold day in hell before he paid me. I got a check about a month later. You can't sell property if there is a judgement against you...

Second guy passed me in a no passing zone waiting in line at the Steele drag strip. You know because he was special and didn't have to wait like the rest of us. The car he was towing had a door open and hit mine. Steel police gave him some static. Dude insisted he was going to send a roll back to my house to pick up my car and fix it himself after I sent him an estimate. I was like hold of chief, I am under no obligation to do you any favors as it relates to saving you money. He said he wouldn't pay. His parents owned the truck. Guess who got a letter their tag was going to be revoked? This guy was in his 30's too. I got my check.

We had the same thing happened. Only appeared to be the wheel cover damaged. They Did not want us to file on insurance insurance. Replaced the wheel cover but continued to have a vibration at 30-40 mph. Ended up bent the rear shaft and damaged drive shaft. I was glad i did file the insurance claim
