Cue the in Alabama your employer can fire you for anything and you can't do anything about it crowd. Not legally, but they can find or create another reason. They could put the fat person on a “layoff “ list and not have to give a reason as to why the fat guy was picked. That’s completely legal. But does not shield them from a wrongful termination civil suit .
