I've heard that if you have a wreck, while driving on roads that the EMA has deemed impassible that your insurance won't pay for the wreck.

I have no plans of driving anywhere today, but I'd like to know, from some of our insurance agents, if that is indeed true.

I need to know that, from an employer perspective. I've never "made" anyone come to work when they thought the roads were dangerous, even to the point of knowing some of the guys were milking it for a day off, but I'd like to know the true legality of it.

In this case, its better to assume its true than to assume its false and find out.

I am also following this closely. We talked about this issue several times yesterday as my son was traveling home from Oklahoma. Several roads he had to travel on were closed.

I have been an insurance agent for 31 years and no policy I have ever sold or read said anything about an exclusion for driving on a closed road. Some "non standard" policies have an exclusion if you are committing a crime but I've never seen that used to exclude coverage for driving on a closed road. However, if they say the road is closed due to weather it is best not to drive on it obviously.

Not true with USAA. No such exclusion in our policy.

Can you get ticketed for traveling a closed road and is it closed if officials call it impassable or does it have to be deemed a closed road?

Not true. Been in insurance claims industry for over 30 yrs. Now, you will be charged with an at fault accident if you wreck your car and file a claim.

In order to be considered closed I'm assuming the road is marked as closed or barricaded?

Currently all roads in Madison, Limestone County are considered impassable. Does that mean if you get in a wreck your insurance won't cover you?

State farm told me as long as your insurance is paid up they have to cover it. Roads closed or not.. their example was what if a family member had to go to the hospital on a closed road and wrecked.Of course they will cover it.

I received a ticket for passing cones a few years back. No road closure sign or anything just 3 cones that you could easily drive through. State Trooper stated Alabama doesn't have enough funding to be able to supply road closure signs on all roads that cones are the same as road closed signs.

Yeah, i dont trust anything ANY state trooper says. Like last year when i got my ticket…he said “i have this road posted at 45mph”. I went back and looked. There is not a speed limit sign ON THAT ROAD, period. State troopers are the rule making up, most arrogant forms of law enforcement there is. But hey, they can drive as fast as they want on THEIR roads. Sorry to de-rail.

I get what you’re saying but I’ve been told by several the posted speed limit is for ideal conditions, not adverse conditions. If it’s not posted it depends if it’s a county road or divided 4 lane and there are laws dictating speed limits for those roads. Now whether a judge upholds that or not depends.

We were friends with a guy that was a judge and he told of several instances where he thru out tickets because of the way posted speed limit signs were located on said road.

I thought in the state of AL that if there is not a sign with a posted speed limit that the default limit is 45mph?
