I might not like the way it looks but I believe he's legal if he's allowed to own a firearm. Rights can sometimes be uncomfortable when exercised in an unconventional way. Now, it probably wouldn't be hard to defend shooting that guy if he so much as pointed in your direction. That makes him stupid but not illegal

It would most likely be a Brandishing charge particularly so because of the mask but I could see where that could be Menacing too
