How is the guy legally burning if they aren’t issuing burn permits? It’s a criminal offense right? Like if you don’t take proper precautions it can be up to a Felony right? He’s not legally burning. It’s a misdemeanor if on your own property. AL law provides landowners the right to burn. We are a right to burn state. However, that does not mean you aren’t liable for your actions. To not be found criminally negligent, you must meet 3 criteria. They are have a burn plan, be certified, and obtain a permit from AFC. Typically, if you act within the parameters of a good burn plan and something happens outside your control, then your liability is minimal. If you act outside the scope of a good burn plan, you’re an idiot, and will be held fully liable. For additional protection, most certified burn managers carry additional insurance if they burn commercially. Well stated. With it being so dry, just you and a garden hose won't cut it.

Matt, any thoughts as to you think this burn ban will be lifted by this weekend? Im not matt, but they’ll open it back up starting tomorrow as long as we get some rain tonight. That and the humidity being above the teens and twenties should make for some less dangerous wather to burn in without scorching the entire county.

I only burn on land that I own, but I carry a million dollar liability policy in case something goes wrong. I have burned around 100 acres every year for the past 21 years, and I have never lost control of a fire, but I take every possible precaution. I have wanted to take the certification class, but it's never worked out to do it. I couldn't burn Friday because I couldn't get a permit, but there were people burning all around me who must not have worried about it. I don't even know which fire caused it, but we had a wildfire yesterday that burned up a trailer a few hundred yards away from my house, and it would have gotten a neighbor's house if the volunteer fire department hadn't put it out. I sure hope we get some rain tonight.

I did get the first permit issued in the State after the ban today - 0305-001!!

I did get the first permit issued in the State after the ban today - 0305-001!! Is there a website that has current information on what burning is allowed? There was nothing on the forestry commission website about it Friday morning; I didn't know about it until I called to get a permit. The guy who answered the phone said that they weren't issuing any permits that day, and he didn't know whether I was certified or not.

You can burn if you pay for the privilege. Or.. if you know the secret, you can burn any time you want. I know the secret. Had a fire tonight that nobody could make me extinguish if I didn't want to..

Had a fire tonight that nobody could make me extinguish if I didn't want to.. Cooking. That's one. There are others, but that's the easiest one. Contained fire. Monitored with precautions. If you've got a hot dog, they can pound sand. I've told a few neighbors that and don't hesitate to tell others. You mind your rat killing. I'll mind mine.

I normally take some hot dogs and buns with me on every burn. Especially if it’s a night burn. Sometimes, I even take some hormel chili if I wanna get fancy.
