On a road where I've walked and jogged for 15 years a homeowner has gotten a large, aggressive dog that comes into the road to chase me in a hostile and threatening manner. I never set foot onto the person's property and have not hit the dog with my walking stick so far. I've faced the dog down and kept him from biting, but he's getting more and more bold.

If a dog comes into a public road to attack a pedestrian, what rights do I have to take force against the dog?

If a dog threatens to attack you when NOT on the owner's property, you can legally shoot the dog.

The law explicitly says that Animal Cruelty Laws do not apply when "Any person who kills a dog or cat found outside of the owned or rented property of the owner or custodian of the dog or cat when the dog or cat threatens immediate physical injury or is causing physical injury to any person, animal, bird, or silvicultural or agricultural industry."

If the dog stays on the owner's property, then you cannot legally do anything about it. Once in the street, it's up to you.

Sure enough, that damn dog came running out, just as I went to stick my leg out to hit it, the damn thing bolted in front of my bike. The last thing I remembered as I was waking up in the middle of the road was flying superman style through the air. Dog never chased me again though grin

In a self defense situation that could vary too. For example,if you go inquire on a Craiglist ad for a 4 wheeler and drive up and are attacked on the property then one isn't going to face charges either. In certain circumstances even being on the owners property the shooting could be justified.

Same as if UPS man shows up and bops a dog on the head because it was threatening.

Pepper spray, wasp spray...with a lighter, amonia...that's all cruel! smile 9mm jhp...not so cruel. I'm really getting tired of critters having more rights/protection than i do. I got a couple new farms I scout west of florence that got dogs (bad). Really thinking about a pocket 22 or 380 to go with my 9mm (that I don't always have on me).

If you have any old golf clubs around the house, a 3 wood is perfect. Lightweight and packs a punch.

Have you talked to the owner or animal control/sheriff dept? I would try that first
