i know a guy that has probably 20 rentals and he says he rarely has a problem. he tells them if they can't or don't intend to pay,and on time, don't rent from me because i'll put you out.then i have heard the horror stories about taking better part of a year to get them out of what is left of your house. could it be a county by county thing that makes the difference?

Evictions are no problem if they leave when told.

I believe the process is spelled out in state law. I know it says that eviction notices have to be served through a sheriffs dept. That is why I never had to fool with them as a municipal officer (thank goodness). We did have to explain to irate landlords all the time, that there was a process you had to go through at the S.O. and you can't just throw their stuff out in the yard. Of course that is when the officers heard about it taking too long and what a screwed up process it is.
I don't know all the particulars of the process since I really wasn't involved in it but I do know landlords don't like it.

actually..evictions are no problem in my experience at all. In 22 years of real estate..Ive done 4-5 evictions.

You give them a seven day notice(demand for rent) after the 5th of the month if they havent paid. Then..after the seven days you go to the court house and for 326 dollars file an eviction...which the sheriffs deputies serve.

They have seven days to appeal. Everyone fails to appear for court. Then the sheriffs deputies show up and remove them from the property.

They used to show up with a crew of work release convicts...who would take the stuff out of the apartment and place it at the curb. We then changed the locks.
Now days they dont use work release people and we have to provide our workers to do it.

I have held 25-30 rental units continously from 1994 on...from four units, to 10 units, 12 units and even 18 units as well as a number of single family homes...and again..in over 22 years...we have only done 4-5 evictions total.

It takes less then 30 days normally...and we can tell if a tenant is scamming us or is really in need of help.
If they are REALLY in need of a little help..we will work with them..but after 22 years..I can tell one who isnt and one who is.

By the way..I just served a seven day demand last friday and am about to issue an eviction. This is a single family home dweller too...which we have never had problems with ( single family I mean).
I figure they will be out within 14 days from now. we believe narcotics are a big part of the problem with them. Theyd rather spend their money on pot then rent it seems.

I deal with this crap almost everyday. The people that don't pay there rent etc can get atleast 6 months of free rent. Before the process is over and the people are evicted. Even though it's private property you can't just throw them out on the street like I would want to. I think you should be able to seize there assets as a form of payment but that's not the way the system works.


LOL..yea,..thats how the system works for us normal folks..but if it is the govt..you just take there cows..(bundy vs BLM). If we did that..we'd be in jail for larceny!

Judge..I see it the way you do. I have had no problem ever in the eviction process..handling it legally. I own a ton of property in Alabama in a couple of counties and it is EXTREMELY easy.

My son is going to school to be a lawyer and recently moved to Birmingham. Your son has been extremely helpful in his advice to me as to where my son should live etc.
You did a good job raising him by the way!

We moved him to Highland park area due to your sons advise..and he has been very happy there. My wife and I visit him and the area is very nice. We even walk around at night to the resturants there.
Like I told Scott..the apple didnt fall too far from the tree with you two!

jeez you all!!! Judge Sharpe is doe killers dad. They are both VERY experienced at law..ones a judge..ones a lawyer.
You all have already alienated one on here..please dont alienate another.

By the way..I have a degree in both Criminal Law..and Business law...and handled correctly evictions are NO problem at all in the state of Alabama!
I guess you all may know more from watching old reruns of Perry Mason..but I highly doubt it.
My son is also going to college to become a real estate attorney..but you all just go on...you must know better then actual college educated folks!

By the way..the reason Ive only done 4-5 evictions..Is I have found a better way. I flash 300 dollars in front of them..and say.."be out by Friday..and this is all yours....but the place has to be CLEAN too!"

Professional leeches know the system and know how to play it to the max. I've dealt with them for the last 30 years.

4-5 evictions in 22 years. Count your blessings. I know landlords that have to do 4-5 evictions a month.

well..Im not a slum lord. I screen my tenants. And Ive NEVER had one EVER show up at court. EVER.
And appeals have to be reasonable to begin with and have a legal basis.
All my rentals are in great shape..and if there are any ..and I MEAN ANY problems of ANY type they are taken care of within 24 hours. That includes even if an HVAC craps the bed..Ill have a NEW ONE in place immediately!
So what would be there basis for an appeal???
They just dont want to pay????

I could see slum lords renting chitty places having problems..but my business is location driven and run, and quality of living run.

If MY WIFE could not live there ALONE Id never offer the place for rent or buy the place to begin with.
If someone has a crappy place with verifable problems I could see it being a problem...and one they deserve.
I dont have those problems..sounds like the people you are talking about are slum lords!

By the way..If they SHOW UP for court...that IS their court date. They would have to file for an extension of another date prior to that! You think they show up and nothing happens????
If they are present...its on like donkey kong!

I deal in Madision, Morgan and Lawrence counties...and Ive never had a problem at all.

Couple of updates
UPDATE April 24, 2014 9:22 AM PDT:

WFLA reports that the squatters appeared to be moving out of Sharkey’s home on Wednesday evening. A mini-van and car were seen in the driveway being packed.

The station noted that veterans groups stepped up offering the Sharkeys help in removing the squatters. Lauren Price of one of the groups, Veterans Warriors, told WFLA, "I don't think [Ortiz is] a squatter. I think he's a criminal and what he did is breaking and entering." The station reports that Price’s group and another veterans advocacy group “found an attorney to handle the eviction process for free,” and they will be watching over the home to make sure the squatters do not vandalize it.

WFLA also notes that more supporters in Tampa Bay had planned a Sunday motorcycle ride to Sharkey’s house to “peacefully make the squatters uncomfortable,” if they hadn’t moved.



UPDATE April 24, 2014 3:18 PM PDT:

WFLA reports that by Thursday morning most of the troublesome squatters’ belongings were gone and the couple had vacated Army Specialist Michael Sharkey’s house. WFLA was on the scene while the squatters packed up their belongings and the station captured video of some bizarre behavior by Ortiz during the move. You can watch that footage here.

Only a few items remained in the front yard and two dogs were left at the house. After Animal Control captured the animals, Julio Ortiz’s friends arrived to retrieve them. Reportedly Duke Energy also arrived at the house to investigate how the squatters managed to get electricity at the home.

Dozens of veterans and neighbors in the area have offered to help at the Veteran Warriors’ planned cleanup and remodel of the home.

Looks like the vets came through for one of their own in FLA. Good for them.

The topic got sidetracked onto Alabama Evictions. Apparently, in some counties it is a bit of a nightmare, in others it is an efficient process. I would advise someone to consider this before investing in rental property.
